By accessing or using any OPBE website, assessment, product, or service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

OPBE is operated by OPBE LLC, a registered limited liability company.

2. Products and Services

OPBE provides digital assessment tools, digital education products, implementation templates, workflow systems, and related services designed for professional service providers and business owners. All products and services are delivered digitally unless otherwise stated.

3. Eligibility

By using our services, you represent that you are at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or any business entity you represent.

4. Payment Terms

All prices are listed and charged in US dollars

Payment is processed securely through Stripe

You agree to provide accurate billing information at the time of purchase

All sales are subject to the refund policy outlined in Section 5

5. Refund Policy

Digital Products: We offer a 7-day review period from the date of purchase. If you have accessed Module 1 of your purchased product and determined it is not the right fit for your needs, you may request a full refund within 7 days of purchase by contacting [email protected]. After 7 days, all sales are final.

Waitlist Enrollment: No payment is collected for waitlist enrollment. No refund policy applies.

6. Intellectual Property

All content, templates, workflows, frameworks, assessments, and materials provided by OPBE are the intellectual property of OPBE LLC and are protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, resell, sublicense, or share any OPBE materials without express written permission.

7. License and Permitted Use

Upon purchase, you are granted a limited, non-exclusive, non-transferable license to use OPBE products for your own personal business operations. You may not:

Share login credentials or product access with any other individual

Resell, redistribute, or sublicense any OPBE content or materials

Use OPBE materials to develop competing products or services

Remove or alter any proprietary notices or branding from OPBE materials

8. Third-Party Tool Recommendations

OPBE products may reference or recommend third-party tools, platforms, or services to support implementation. These recommendations are provided for informational purposes only and do not constitute endorsements. We are not responsible for the performance, pricing, availability, or terms of any third-party product or service. Your use of any third-party platform is governed by that platform's own terms and conditions.

9. Disclaimer of Warranties

OPBE products and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee specific business outcomes, revenue results, or operational improvements. Results depend on individual implementation, effort, and market conditions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, OPBE LLC, its members, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — OPBE products or services. Our total aggregate liability for any claim arising under these Terms shall not exceed the total amount you paid for the applicable product or service.

11. Indemnification

You agree to indemnify and hold harmless OPBE LLC and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in the State of Ohio, except where prohibited by law.

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of our services after any changes constitutes your acceptance of the updated Terms.
